Terms and Conditions

Welcome to Saigon Adventure. These Terms and Conditions (“Terms”) govern the booking and use of tours and services provided by Saigon Adventure (“we”, “us”, “our”), a tour operator based in Ho Chi Minh City, Vietnam. By booking a tour with us, you (“customer”, “traveler”) agree to be bound by these Terms.

1. Booking and Confirmation

A booking is considered confirmed once we receive your full payment or deposit through one of our accepted payment methods (see our Payment Policy). You will receive a confirmation email or message with your tour details, pickup information, and booking reference.

2. Eligibility and Participation Conditions

  • Travelers under 18 years of age must be accompanied by a parent or legal guardian.
  • Some tours (e.g. Cu Chi Tunnels, motorbike tours) involve physical activity such as walking, crawling through tunnels, or riding on a motorbike. Travelers should be in reasonably good health and should inform us in advance of any medical conditions, disabilities, or special requirements.
  • Certain tours require a minimum number of participants to operate. If the minimum is not met, we will offer an alternative date or a full refund.
  • We reserve the right to refuse participation to any traveler who, in our reasonable judgment, may endanger their own safety or that of other participants and guides.

3. Traveler Responsibilities

  • Please arrive at the designated pickup point on time. We are not responsible for delays or missed tours caused by the traveler’s late arrival.
  • Bring a valid passport/ID where required for the destinations visited.
  • Follow your guide’s safety instructions at all times, especially during activities such as tunnel visits, boat trips, or motorbike rides.

4. Our Rights

Saigon Adventure reserves the right to:

  • Adjust the itinerary, means of transport, guide, or schedule when necessary for safety, weather conditions, or circumstances beyond our control, while keeping the overall experience as close as possible to what was booked.
  • Cancel or postpone a tour due to severe weather, natural disasters, government restrictions, insufficient participants, or other force majeure events. In such cases, customers may choose a rescheduled date or a refund as described in our Cancellation & Refund Policy.

5. Liability

Saigon Adventure takes reasonable care to ensure the safety and quality of every tour. However, we are not liable for injury, loss, delay, or damage caused by circumstances beyond our reasonable control, including but not limited to weather, traffic conditions, third-party service providers, or a traveler’s own actions. We strongly recommend that travelers purchase personal travel insurance before joining any tour.

6. Photography and Marketing

Photos or videos taken by our guides during a tour may be used for marketing purposes on our website and social media channels. If you do not wish to be included, please inform your guide or contact us in advance.

7. Force Majeure

We are not responsible for any failure to perform our obligations where such failure results from events beyond our reasonable control, including natural disasters, epidemics, war, strikes, or government action.

8. Governing Law

These Terms are governed by the laws of Vietnam. Any dispute will first be addressed through good-faith negotiation between the parties.
